Electronic Signature and Records Consent

Please read and save this consent before continuing. Electronic signing is optional. The Sender is the app holder identified in the invitation email who requested your signature. That app holder is sending the document using Flip A Whip technology. Flip A Whip LLC provides the signing platform and is not the Sender merely because its platform sends an email.

1 Scope of your consent

Your consent applies only to the document or documents presented through the signing link in the invitation email accompanying this consent, and the related signing notices, disclosures, completed copies, and completion records. A separate document title is not required in this consent; the records covered are those shown to you in that signing session. This consent does not authorize unrelated future transactions or marketing communications.

2 Your choice and intent to sign

You may decline electronic signing and ask the Sender about a paper or other lawful alternative. Accepting this consent permits electronic delivery and signing; it does not itself mean you agree to the underlying document. By deliberately applying your electronic signature and selecting the final signing action, you intend to sign and agree to the document presented to you. You intend your electronic signature to have the same effect as your handwritten signature to the extent permitted by applicable law. Review every page before signing. Do not continue if the document is incomplete, incorrect, unreadable, or not intended for you.

3 Access and technology requirements

You need a device with internet access, an active email account for this invitation, and a current web browser that can display the signing page. You also need software or browser capability to open PDF files, and a way to save them or print them. Before agreeing, open the consent PDF supplied with your invitation or on the signing page, and confirm that you can read and save or print it. If you cannot, stop and contact the Sender. Material changes to access requirements will be disclosed, with an opportunity to withdraw consent and renewed access confirmation where required.

4 Paper copies and declining electronic delivery

You may print this consent attached to the invitation email and the completed signed document emailed to you. You may also request a paper copy or a non-electronic signing alternative by contacting the Sender using the contact information in the invitation email. Refer to the invitation and signing date so the Sender can identify your request. No fee is charged by Flip A Whip for declining electronic signing, withdrawing this consent, or obtaining the electronic copies described here. This consent does not authorize the Sender to charge a paper-copy fee; any such fee must be lawful and separately disclosed before you agree. Choosing a non-electronic method may delay processing while the Sender arranges an alternative. You retain your rights to records and remedies under applicable law.

5 Withdrawing consent and updating contact information

Before completing signing, you may stop the process and contact the Sender using the contact information in the invitation email to withdraw consent or request a non-electronic alternative. After signing, contact the Sender to withdraw consent for any remaining electronic deliveries connected to that signing session. Withdrawal takes effect within a reasonable time after receipt and does not, by itself, cancel the transaction or invalidate signatures or records already lawfully provided. Contact the Sender through the invitation email contact information to update your email address or report a delivery problem. If the invitation lacks working Sender contact information, do not proceed; contact admin@flipawhip.com for assistance identifying the Sender. Do not send sensitive documents to that general support address.

6 Identity and authority

You confirm that you are the intended signer and that the information you provide is accurate. If signing for a business or another person, you confirm that you have lawful authority to do so. Do not forward the signing link or share verification codes with unauthorized people. Notify the Sender immediately if this invitation reached the wrong person or you suspect unauthorized use.

7 Completed documents and storage

After signing is complete, a printable copy of the completed signed document is emailed to you at the email address used for the signing invitation, unless you arrange an updated address with the Sender. This consent is attached to the invitation email for saving and printing and is available on the signing page. Save both emails and promptly download the consent and completed signed document to secure storage. If the completed copy does not arrive, check your spam folder and contact the Sender. Do not assume an email was received merely because it was sent. A signing link or in-app inbox is not a permanent archive; any link expiration will be disclosed separately. The Sender is responsible for retaining its business records and providing copies required by law. Your responsibility for your copies does not remove the Sender’s or Flip A Whip’s obligations under applicable law.

8 Flip A Whip’s role and limits

Flip A Whip provides signing and delivery tools and is not a party to your agreement with the Sender merely because its technology is used. The Sender is responsible for the document’s content, transaction terms, its authority, and legally required disclosures. Flip A Whip does not provide legal advice, notarization, a guarantee of identity, or a guarantee that every document is enforceable. Direct questions about the document, transaction, copies, or withdrawal to the Sender. For technical assistance, contact admin@flipawhip.com. To the extent permitted by law, Flip A Whip is not responsible for the Sender’s independent representations, conduct, or handling of records, or your misuse of a signing link. Nothing here waives nonwaivable rights, excludes liability prohibited by law, or excuses Flip A Whip’s own legally required duties. This consent does not impose Business User subscription or indemnification obligations on you.

9 Signing records and privacy

The signing process may record consent, signature actions, timestamps, document identifiers, verification events, and technical information such as IP address and browser or device details, as described in the applicable Privacy Policy and actual service functionality. These records may be associated with the document to help evidence the transaction. Review the Flip A Whip Privacy Policy linked on the signing page and any applicable Sender privacy notice.

Your affirmative consent

By checking the consent box and selecting Agree and Continue, I confirm that I have read this Electronic Signature and Records Consent, can open and save or print the attached consent PDF, and voluntarily agree to electronic delivery and signing of the document or documents presented through this invitation’s signing link. I understand that the Sender is the app holder identified in the invitation email, that a printable completed signed document will be emailed to me, and that I may request paper copies or withdraw consent as described above. I understand that signing each underlying document requires a separate deliberate signing action
