Flip A Whip LLC (“Flip A Whip,” “we,” “us,” or “our”) respects your privacy and is committed to protecting personal information collected through the Flip A Whip mobile application, the Flip A Whip website, and related services (collectively, the “Services”).

Flip A Whip provides technology designed primarily for automobile dealerships, automobile sales professionals, and other authorized automotive businesses and personnel (“Business Users”). The Services allow Business Users to communicate with prospective and existing customers and facilitate activities such as credit applications, vehicle trade appraisals, customer information collection, document collection, lead management, customer follow-up, and other vehicle-shopping and dealership-related activities.

This Privacy Policy describes the information we may collect and process, how that information may be used and disclosed, how we seek to protect it, and the choices available to users.

By accessing or using the Services, you acknowledge the practices described in this Privacy Policy.

1. Information We Collect

The information collected depends upon the features of Flip A Whip being used and the information voluntarily provided by customers and Business Users.

  • Date of birth
  • Email address
  • Mobile telephone number
  • Work telephone number
  • Current residential address
  • Previous residential address
  • Length of residence
  • Other contact information voluntarily provided

Credit Application and Financial Information

  • Last four digits of Social Security number, when requested
  • Housing status
  • Monthly rent or mortgage payment
  • Landlord or mortgage holder information
  • Employment information
  • Employer name and address
  • Employer telephone number
  • Occupation
  • Length of employment
  • Previous employment information
  • Gross salary

An applicant is not required to disclose alimony, child support, or separate maintenance income unless the applicant wishes to have such income considered in connection with the applicable credit transaction.

If Flip A Whip's credit application is later configured to collect a full Social Security number or additional sensitive financial information, this Privacy Policy may be updated accordingly.

Customers may be permitted to upload photographs, videos, or documents requested by a Business User in connection with a vehicle transaction.

2. How We Use Information

  • Provide, maintain and operate the Services
  • Facilitate communications between customers and Business Users
  • Facilitate customer-requested credit applications
  • Facilitate vehicle trade appraisals
  • Transmit customer-submitted information to the appropriate Business User or dealership
  • Manage customer leads and related activities
  • Provide account and subscription functionality
  • Authenticate users
  • Send transactional emails, text messages, confirmations and service-related communications
  • Provide customer support
  • Maintain and improve the Services
  • Diagnose technical problems
  • Protect against fraud, abuse, unauthorized access and other unlawful activity
  • Comply with legal and regulatory requirements
  • Enforce our agreements
  • Protect Flip A Whip LLC, our users and others

Flip A Whip LLC does not sell personal or sensitive customer information.

Information submitted for a credit application, trade appraisal, or other dealership transaction will not be used by Flip A Whip for unrelated advertising purposes.

3. Relationship Between Flip A Whip and Business Users

Flip A Whip provides a technology platform through which customers can securely provide information requested by a dealership, salesperson, or other Business User.

When a customer accesses a link supplied by a Business User and submits information, the information may be made available to that Business User and, where applicable, the dealership or organization with which that Business User is affiliated.

Flip A Whip LLC and the applicable Business User may have separate legal responsibilities concerning personal information depending upon the circumstances and applicable law.

Business User Responsibility for Customer Information

Each Business User is responsible for protecting all customer personal, financial, credit-related, vehicle, and other information that the Business User receives, accesses, downloads, exports, prints, copies, stores, or otherwise obtains through Flip A Whip.

  • Maintaining the confidentiality and security of customer information
  • Restricting access to individuals who have a legitimate business need to access the information
  • Maintaining reasonable administrative, technical, and physical safeguards
  • Protecting account credentials and devices used to access Flip A Whip
  • Preventing unauthorized access, disclosure, copying, distribution, or use of customer information
  • Using customer information only for legitimate and lawful business purposes
  • Obtaining any notices, authorizations, or consents required by applicable law
  • Complying with applicable privacy, consumer-protection, credit, financial-services, data-security, advertising, communications, and other laws and regulations
  • Properly securing information downloaded or exported from Flip A Whip
  • Properly disposing of customer information when retention is no longer legally or operationally necessary
  • Promptly addressing suspected unauthorized access to customer information under their control

Business Users may not sell, improperly disclose, publicly expose, misuse, or permit unauthorized access to personal or sensitive information obtained through Flip A Whip.

Information After Delivery to a Business User

Once customer information has been lawfully delivered to, downloaded by, exported by, or otherwise placed under the independent control of a Business User, dealership, lender, or other authorized third party, that party becomes responsible for its independent handling, storage, use, disclosure, retention, and security.

To the maximum extent permitted by applicable law, Flip A Whip LLC is not responsible for the independent acts or omissions of a Business User, dealership, lender, financing source, or other third party concerning information after such information has been lawfully transferred to or placed under that party's independent control.

This provision does not eliminate or limit Flip A Whip LLC's responsibility for information while it remains under Flip A Whip's control or otherwise where responsibility cannot lawfully be excluded.

4. Credit Applications and Financing

Flip A Whip provides technology that facilitates the collection and transmission of information that may be used in connection with vehicle financing.

Flip A Whip LLC is not a bank, lender, credit union, finance company, credit bureau, or consumer reporting agency and does not itself make lending, financing, or credit-approval decisions unless expressly stated otherwise.

Submitting a credit application through Flip A Whip does not guarantee:

  • Credit approval
  • Vehicle financing
  • A particular interest rate
  • A particular monthly payment
  • A particular loan term
  • Vehicle availability
  • Any other financing terms

Credit and financing decisions may be made independently by dealerships, banks, credit unions, finance companies, lenders, or other authorized financing sources.

5. Co-Applicants

If a customer elects to include a co-applicant, additional personal and financial information concerning the co-applicant may be collected. Business Users must not submit or request another person's sensitive personal information without appropriate authorization.

6. How We Disclose Information

  • The dealership, salesperson, or Business User to whom a customer intentionally submits information
  • Authorized personnel within the applicable dealership or organization
  • Financing sources or service providers when necessary to facilitate a customer-requested transaction and when appropriately authorized
  • Technology providers that assist Flip A Whip with cloud hosting, databases, authentication, communications, email, application functionality, analytics, security, subscriptions, and other operational services
  • Professional advisers where reasonably necessary
  • Government agencies, courts, law enforcement, or other parties when required by law
  • Parties necessary to protect against fraud, abuse, security threats, or unlawful conduct
  • A successor organization in connection with a merger, acquisition, financing, restructuring, sale, or transfer of some or all of Flip A Whip LLC's business or assets

7. We Do Not Sell Customer Personal Information

Flip A Whip LLC does not sell customer personal information or sensitive financial information.

We do not provide credit-application information to unrelated third parties for their independent advertising or marketing purposes.

8. Data Security

Flip A Whip LLC uses reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, acquisition, disclosure, alteration, destruction, loss, or misuse.

However, no Internet transmission, mobile application, computer network, electronic storage system, or security system can be guaranteed to be completely secure. Accordingly, Flip A Whip cannot guarantee absolute security.

Business Users are responsible for protecting their login credentials and maintaining appropriate security on devices used to access Flip A Whip.

9. Data Retention

Flip A Whip retains personal information only for as long as reasonably necessary to provide the Services, complete the purposes for which information was collected, satisfy contractual obligations, resolve disputes, prevent fraud or abuse, establish or defend legal claims, and satisfy applicable legal or regulatory requirements.

10. Data and Account Deletion

Individuals may request deletion of eligible personal information maintained by Flip A Whip by contacting: admin@flipawhip.com.

Business Users may request deletion of their Flip A Whip account and eligible associated account information through any account-deletion functionality provided in the Services or by contacting us.

11. Third-Party Service Providers

Flip A Whip may use third-party providers for cloud infrastructure, database services, authentication, email and communications, analytics, crash reporting, subscription management, security, and other technical functionality.

Purchases and subscriptions made through the Apple App Store or Google Play are also subject to the privacy practices and terms of those platforms.

12. Device Permissions

Certain features may request access to:

  • Camera
  • Photo library
  • Notifications
  • Other device capabilities necessary for requested functionality

13. Children's Privacy

The Services are not directed to children under 13, and Flip A Whip LLC does not knowingly collect personal information from children under 13.

14. Privacy Rights and Requests

Depending on applicable law, users may have rights to request access, correction, deletion, or other information regarding their personal information.

15. Communications

Flip A Whip and Business Users may use contact information submitted through the Services to communicate regarding a customer's inquiry, credit application, vehicle trade appraisal, appointment, requested transaction, or related dealership activity.

Business Users are independently responsible for complying with applicable laws governing telephone calls, text messages, email, marketing communications, consent, and opt-out requests.

16. Changes to This Privacy Policy

Flip A Whip LLC may update this Privacy Policy periodically to reflect changes in the Services, technology, information practices, security practices, laws, regulations, or business operations.
